  The article presents the causality of marital consent in the formation of a marriage. It is proposed that the nupturient should be characterised by adequate personal maturity and have legal capacity. An analysis of the reasons for a serious lack of evaluative discernment as well as consensual capacity allows to conclude that the proper maturity in the intellectualand the volitional spheres as well as the possession of theoretical-practical judgement are essential. The dyssocial personality which is a disorder that affects evaluative discernment in the counterparty is also presented in this context. It is demonstrated that the onset of the disorder with a dissocial trait is connected with the generational family that influences inappropriate personality development which in turn can have a serious impact on the ability to take and fulfi l the marital duties.;
  Małżeństwo w Kościele katolickim jest uznawane za instytucję pochodzącą bezpośrednio z Objawienia Bożego. Za początek i przyczynę sprawczą małżeństwa uznaje się zgodę małżeńską. Jednak jest niezbędne, aby nupturienci chcący zawrzeć sakramentalny związek małżeński byli zdolni do wyrażenia ważnego aktu zgody małżeńskiej. Jedną z form niezdolności konsensualnej jest brak rozeznania oceniającego co do istotnych praw i obowiązków małżeńskich wzajemnie przekazywanych i przyjmowanych. W niniejszym artykule autor ukazuje wpływ osobowości dyssocjalnej (ICD – 10) na poważny brak rozeznania oceniającego, w świetle prawodawstwa kościelnego, który jest istotnym czynnikiem wpływającym na stwierdzenie nieważności małżeństwa.
