The first codification of inheritance law in Lithuania was enshrined in the 1st Lithuanian Statute of 1529. Subsequent amendments to the Statute took effect in 1566 and 1588. They set forth the principles of bequeathing that provided that the last will was to be made when thetestator was still in good health, it required the presence of witnesses, and needed to be subsequently endorsed by a court with proper jurisdiction. When the first two Statutes were in force, frequent witnesses of the will were members of the clergy who, apart from enjoying respect, belonged to the relatively small group of the literate in those times. Later, however, in the 17th and 18th centuries, it was members of the family, or friends, who were called to testify, and the last will made in accordance with the binding laws was subsequently enforced upon the testator's death, even if it lacked the seal. The Lithuanian inheritance law was adjusted to the needs of the people in Lithuania, where acts of the last will were usually drafted in the last weeks of a person's life, when the illness prohibited the testators to make a will in the presence of a clerk in office. The Act provided for such situations, thus enabling the ill, disabled and the illiterate to leave a will as well. After the testator's death, the last will was executed and duly entered in land and mortgage (land register) files. The entries included: the date of the act, entered according to the Julian or Gregorian calendar, the names of the witnessing clerks, information on the persons present at the activation process, as well as the details of the testator and the beneficiaries of the will. The last will was usually read out at the funeral. Certain legacies, e.g. in favour of churches or temples, were frequently challenged by the family of the testator. In towns and cities, the principles of inheritance were usually regulated by Magdeburg law, which sought to protect the interest of natural heirs. It included a remedy not known in statutory law, i.e. specific performance, obliging to implement the last will within a year. That principle did not, however, precise the date of which that one-year period would run: the death of the testator, or the date at which the will was filed for activation. Further, last wills could not be executed if they contained provisions contradictory to common law, good practice, or the principles of piety or honesty. Last wills of the modern times made in the territory of the Grand Duchy of Lithuania had a specific structure and consisted of a preliminary protocol (invocativo, intitulario, arenga, a testing ability condition); the actual part (dispositio, corraboratio) and a final protocol (date, witness details, signatures);
En Lituanie la première codification du droit de succession se trouve dans le Statut Ier de 1529. Les corrections nécessaires furent introduites à deux Statuts postérieurs promulgués en 1566 et 1588. On y a définit les principes de tester, notament que l'acte de la dernière volonté devrait être établi dans l'état de la bonne santé du de cujus, devant les témoins et ensuite confirmé dans l'office compétent. L'acte de la dernière volonté conforme à la loi ne jouissait du viguer de droit qu' après la mort du testateur, même s'il a oublié mettre y son cachet. Le droit lituanien de succession répondait aux besoin des habitants. Le plus souvent les actes de la dernière volonté n'ont été faits qu'aux semaines dernières de la vie, quand la maladie ne permettait pas de le faire dans l'office. Dans ce cas, on appliquait les principes statutaires donnants la possibilité de faire des actes de la dernière volonté aux personnes malades, handicapés et illetrés. En cas de besoin, on détournait les dispositions légales. Il s'agissait surtout de l'entremise dans la corroboration des testaments, de l'enregistrement de ces derniers dans les offices par les femmes, ainsi que de la certification des actes de la dernière volonté par celles-ci. près la mort du de cujus il est arrivé à l'enregistrement (en polonais : aktykacja) du testa[1]ment dans les livres judiciaires (en polonais : księgi sądowe) appelés ziemskie ou grodzkie. Pour des raisons pratique, notamment à cause de la facilité de l'accès, on enregistraient les testaments plus souvent aux księgi grodzkie qu'aux księgi ziemskie. Dans l'enregistrement des testament les chancelleries se servaient les formulaires typiques. Après l'enregistrement il arrivait à la publication du testament ce qu'on faisait souvent pendant les funérailles. Bien après il fallait réaliser la volonté du défunt. Souvent les legs en faveur des églises catholiques et ortodoxes provoquaient les conflits entre la famille et le clergé. Au Temps moderne en Lituanie, c'est le droit de Magdeburg qui réglait les principes de succession dans les villes. Pareillement au droit » terrien « (ius terrestre), ce droit défendait les intérêts des successeurs naturels. Selon ce droit, l'exécution du testament devait être achevée pendant un an - les Statuts lituaniens ne connaissait pas un principe pareille - mais il ne précisait pas s'il s'agissait de la date de la mort ou la date de l'enregistrement officiel du document. L'exécution du testament n'était pas possibile s'il contenait les dispositions contraires au droit commun (en polonais : prawo pospolite), aux lois de la ville donnée (en polonais : wilkierze), aux bons moeurs, aux règles de la piété et de l'honnêteté. En Lituanie de l'époque moderne les testaments possédaient une structure typique composée des éléments suivants: le protocole préliminaire (invocatio, intitulatio, arenga, conditio testationis); la partie essentielle (dispositio, corroboratio) ; le protocole final (datum, noms des temoins, signatures).
