  The article proposes a solution to the problem of the collision of two personal rights on differing stages of doctrinal and jurisprudential development, namely, the sense of national identity and artistic freedom. The importance of this issue is influenced by the fact that the topic of a sense of national identity as a personal right has only recently become an object of doctrinal consideration. On the basis of the relevant literature and case law, the article presents methods of resolution of the collision in the form of the primacy rule and the reduction rule. The proposed model indicates the validity of resolving conflicts on the basis of the principle of the proportional reduction of conflicting rights, where the court’s decision should be based on values consistent with constitutional axiology and should take into account Article 31(3) of the Polish Constitution.;
  Celem pracy jest rozważenie możliwości rozwiązania kolizji między poczuciem tożsamości narodowej a wolnością artystyczną, dobrami osobistymi o różnym stopniu ugruntowania na płaszczyźnie orzeczniczej i doktrynalnej. Na znaczenie podejmowanej problematyki wpływa fakt, że tematyka dóbr osobistych z perspektywy dobra osobistego w postaci poczucia tożsamości narodowej dopiero od niedawna jest obiektem badawczym rozważań doktrynalnych. Na podstawie literatury przedmiotu oraz orzecznictwa wskazane zostały dwa sposoby usunięcia kolizji praw podmiotowych, tj. zasada pierwszeństwa oraz zasada redukcji. Zaproponowany model wskazuje na słuszność rozstrzygania kolizji na kanwie zasady proporcjonalnej redukcji kolidujących ze sobą praw, przy czym orzeczenie sądu powinno opierać się na wartościach zgodnych z aksjologią konstytucyjną oraz uwzględniać działanie art. 31 ust. 3 Konstytucji RP.
