  The article deals with the possibility of legally purchasing of alcoholic beverages online, in light of the current provisions of the Act on Upbringing in Sobriety and Counteracting Alcoholism. The authors discuss both public law and private law issues, highlighting the permissibility of trading in alcoholic beverages via the Internet, contrary to previous case law and doctrinal views. In doing so, they provide an in-depth analysis of the provisions of civil law and public law regulations on undertaking and conducting business activity, as well as the legal conditions that allow its restriction.;
  Artykuł dotyczy możliwości legalnego nabywania napojów alkoholowych w Internecie w świetle obecnej regulacji ustawy o wychowaniu w trzeźwości i przeciwdziałaniu alkoholizmowi. Autorzy omawiają zagadnienia publicznoprawne oraz prywatnoprawne, wskazując wbrew dotychczasowemu orzecznictwu oraz poglądom doktryny na dopuszczalność obrotu napojami alkoholowi w sieci Internet. Sięgają przy tym do pogłębionej analizy przepisów prawa cywilnego oraz regulacji publicznoprawnych dotyczących podejmowania i prowadzenia działalności gospodarczej oraz prawnych przesłanek umożliwiających jej ograniczenia.
