The subject of the commentary is the judgment of the District Court in Gdańsk,which dismissed the appeal brought by the bank against the judgment of the Court of firstinstance. This judgment ordered the bank to pay the consumer a sum of money for unjustenrichment, together with interest and litigation costs. As rightly stated by the courts ofboth instances, upon the transfer of the debt confirmed by the bank enforcement order by the bank to the entity other than the bank, the vendor of the claim should notify theenforcement bailiff of this fact with a request for its remission. The continuation of theenforcement constitutes an unlawful act of the bank, resulting in unjustified enrichmentat the expense of the former debtor. Such an assessment is not changed by the fact thatthe bank transfers the enforced funds to the buyer of the debt, as the latter cannot benefitfrom the former, but should bring an action against the debtor for payment on generalrules. The judgment deserves approval, and due to its practical dimension, also an in-depthcommentary and dissemination.;
Przedmiotem glosy autor uczynił wyrok Sądu Okręgowego w Gdańsku, mocąktórego oddalono apelację wniesioną przez bank od wyroku Sądu I instancji. Wyrokiem tymzasądzono od banku na rzecz konsumenta kwotę pieniężną z tytułu bezpodstawnego wzbogaceniawraz z odsetkami i kosztami procesu. Jak słusznie stwierdziły sądy obu instancji,z chwilą przelewu wierzytelności stwierdzonej bankowym tytułem egzekucyjnym dokonanegoprzez bank na rzecz podmiotu niebędącego bankiem, zbywca wierzytelności powinienpowiadomić o tym fakcie komornika prowadzącego egzekucję i zwrócić się z wnioskiemo jej umorzenie. Kontynuacja egzekucji stanowi bezprawne działanie banku, skutkującebezpodstawnym wzbogaceniem kosztem byłego dłużnika. Takiej oceny nie zmienia faktprzekazania przez bank wyegzekwowanych środków nabywcy wierzytelności, gdyż ten niemoże korzystać z dobrodziejstwa b.t.e., lecz powinien wystąpić przeciwko dłużnikowi z powództwemo zapłatę na zasadach ogólnych. Wyrok zasługuje na aprobatę, a z uwagi na jegopraktyczny wymiar także na pogłębiony komentarz i upowszechnienie.
